Nashville Car Wreck

When I first began practice over a decade ago a car wreck was strictly handled by the adjuster and the attorney working for the client, however things have changed very dramatically in the last 10 to 12 years. There are so many factors that an insurance company now reviews on each and every claim, if the days of simply submitting bills and receiving a settlement were every really in existence, they are long past. It is only through hard work that good results are achieved. 

How insurance companies review claims 

The insurance companies now generally use software programs to produce settlement numbers for your claim, they do not take into account your pain and suffering, they use factors in a car wreck case like, number of diagnostic tests you have had done, and their total cost; the damage done to your car in terms of money;  is this a soft tissue accident; any surgeries; broken bones.

In Tennessee, your car accident case settlement can also be reduced if the insurance company can show that you are even one percent at fault, this is referred to as Comparative Fault. This can take into account whether you were speeding, whether you slowed down in rainy conditions, whether you could have avoided the other persons car, did you take any action to avoid it? These are but a few of the reasons that an insurance company in Tennessee could either lower your settlement or all together deny your claim against their driver.

It is by hard work and diligence that a car wreck claim can be presented properly to the insurance company. In my experience it is extremely important to present your documented case in a concise manner to the adjuster, and if things cannot be worked out with adjuster, then you have already built a solid foundation with which to work on your client’s case. There is just no other way to properly represent a client on a car wreck case, other than through hard work and dedication, there are no substitutes to producing good results.
